Everyone’s talking about the 15% tariff. Wrong, you should look at the 50% number. Why?
• Section 338 (Tariff Act of 1930) allows tariffs up to 50%
• No investigation
• No ITC process
• No injury finding
• No expiration
• Country-specific
• Immediate implementation It’s never been used in 96 years.
Section 122 - capped at 15% (and expires)
Section 232 - 9–12-month process
Section 301 - hearings & public comments
The "Plan B": Treasury Secretary Bessent and USTR Greer have already signaled that Section 338 is the "equipped" mechanism for the post-IEEPA world. Only Section 338 can replicate IEEPA-style power:
Fast. Broad. Durable.
The markets are speculating a step-down. Trump may be preparing for a step-up. The real risk isn’t 15%. It’s 50%.... Overnight.
