Лекция 4. Защита независимости судебной системы (Danileț против Румынии)
15 декабря 2025 года Большая палата ЕСПЧ вынесла знаковое решение, признав Румынию виновной в нарушении статьи 10 Европейской конвенции по правам человека, гарантирующей свободу выражения мнения.
Независимость судебной системы невозможна без права судей публично обсуждать угрозы демократическим институтам. Это дело подтвердило: дисциплинарные наказания за высказывания судей допустимы только при наличии реального вреда, а не просто критики в адрес властей.

Что было нарушено и почему:
Судья румынского суда публиковал в Facebook* посты, в которых обсуждал политические атаки на государственные институты и поднимал вопрос о возможном участии армии в защите демократии. За эти публичные комментарии румынские власти применили к судье дисциплинарное взыскание.

Решение ЕСПЧ:
Суд постановил, что такое взыскание является неправомерным вмешательством в свободу выражения мнения. Суд подчеркнул: судьи не лишаются права участвовать в публичных дискуссиях о независимости судебной системы под угрозой дисциплинарных санкций, поскольку посты были направлены именно на защиту независимости демократических институтов и не содержали призывов к насилию.

Румынские суды, по мнению Страсбургского суда, не предоставили конкретных доказательств того, что сообщения подорвали независимость судебной системы или доверие к ней. Lecture 4. Protecting the independence of the judiciary (Danileț v. Romania)
On 15 December 2025, the Grand Chamber of the European Court of Human Rights delivered a landmark judgment, finding Romania in violation of Article 10 of the European Convention on Human Rights, which guarantees freedom of expression.
Judicial independence cannot exist without the right of judges to publicly discuss threats to democratic institutions. This case confirmed that disciplinary sanctions against judges for their statements are permissible only when actual harm is proven — not merely for criticising the authorities.

What was violated and why:
A Romanian judge posted on Facebook* about political attacks on state institutions and raised the question of possible army involvement in defending democracy. For these public comments, the Romanian authorities imposed a disciplinary sanction on the judge.

The ECtHR ruling:
The Court held that such a sanction constituted an unjustified interference with freedom of expression. The Court stressed that judges do not lose their right to participate in public debates about the independence of the judiciary under threat of disciplinary penalties — because the posts were aimed at protecting the independence of democratic institutions and contained no calls for violence.

Why it matters for the state:
In the Strasbourg Court’s view, the Romanian courts failed to provide specific evidence that the messages undermined the independence of the judiciary or public confidence in it. Accordingly, the fundamental right to freedom of expression — one of the foundations of a democratic society — was violated.

Conclusion: The ECtHR judgment in Danileț v. Romania strengthens standards for protecting judicial independence. It reminds states that judges’ freedom of speech is not a privilege but an essential tool for resisting political pressure on the justice system.
