• 16 באוקטובר 58' - גזר הדין: רס"ן שמואל מלינקי הורשע ברצח 43 אזרחים ונידון ל-17 שנות מאסר; סגן גבריאל דהאן (רצח 43 אזרחים) - 15 שנות מאסר; טר"ש שלום עופר (41 מעשי רצח) - 15 שנות מאסר; טוראים מחלוף הרוש ואברהם אליהו (22 מעשי רצח) - 7 שנות מאסר; רב"ט גבריאל עוליאל וטוראים אלברט פחימה ואדמונד נחמני (17 מעשי רצח) - 7 שנות מאסר (רב"ט איסמעיל עבד אל-רחמן וטוראים סעיד שעבאן ודניאל סמיניץ, שנאשמו ברצח שני אזרחים, זוכו מאשמה).

ערב "מבצע קדש" (מלחמת סיני), ביום 29 באוקטובר 1956, הוחלט להקדים לשעה חמש בערב את העוצר שקוים אותה תקופה בכפרים הערביים באזור "המשולש", אשר היו תחת ממשל צבאי. גדוד מילואים של משמר הגבול הונחה לאכוף את העוצר בחומרה ולירות במפריו. מפקד הגדוד, רס"ן שמואל מלינקי, העביר את פקודת העוצר תוך הנחייה לירות בכל מי שיימצאו מחוץ לביתם בשעות העוצר וכי מוטב שיהיו מספר הרוגים בלילה, משום שזה יקל על שמירת העוצר בלילות הבאים. כשנשאל מלינקי על ידי פקודיו - מה לגבי תושבים שיחזרו לביתם מן השדות, מבלי שנודע להם על הקדמת העוצר, השיב כי "דינם כדין כולם" ועל פי חלקם הוסיף "אללה ירחמו, כך אמר מפקד החטיבה", ברמיזה להורגם. לשאלה כיצד לנהוג בנשים ובילדים השיב כי יש לפעול "בלי
סנטימנטים".

העוצר חל על שמונה כפרים. מרבית המפקדים על גזרות הכפרים פעלו במטרה למנוע הרג אזרחים. לעומתם, סגן גבריאל דהאן, שפיקד על אזור כפר קאסם, העביר לחייליו את הפקודות כרוחן וכלשונן, וחייליו ירו למוות ב-47 מתושבי הכפר שחזרו לבתיהם ופצעו עוד מספר עשרות. 43
